Is It Legal to Gift Cannabis in New York? The 3-Ounce Rule, “Gifting” Shops, and Holiday Giving Done Right

Yes. A New York adult 21 or older may give up to 3 ounces of cannabis flower or 24 grams of concentrate to another adult 21 or older, as long as nothing is exchanged for it. Payment, trade, or a “free gift with purchase” makes it an unlicensed sale, and giving cannabis to anyone under 21 is a crime.

What New York’s gifting rule actually says

The rule comes from the Marihuana Regulation and Taxation Act, now written into Penal Law § 222.05. Subdivision 1(b) makes it lawful for a person 21 or older to transfer, “without compensation, to a person twenty-one years of age or older,” up to three ounces of cannabis and up to twenty-four grams of concentrated cannabis.

Three conditions sit inside that sentence, and all must be true at once: the giver is 21 or older, the recipient is 21 or older, and nothing of value changes hands. Miss any one and the transfer is no longer protected. This guide is for adults 21 and over with a valid government-issued ID who buy from a licensed New York dispensary; it summarizes public law and is not legal advice.

How much cannabis can you gift in New York?

Up to 3 ounces of flower or 24 grams of concentrate per transfer, the same amount an adult may carry in public. There is no separate gift allowance on top of your own limit: if you are carrying a gift and your own purchase, the combined weight still has to stay under 3 ounces and 24 grams, or you are in unlawful possession territory (a violation with a fine of up to $125, and a misdemeanor above 16 ounces).

At home the ceiling is higher. Penal Law § 222.15 lets adults keep up to five pounds in a private residence, provided it is kept in a secured place not accessible to anyone under 21. A box of gifts waiting for a December party is fine in a locked closet; the 3-ounce figure matters once you walk out the door. Our New York cannabis laws guide has the full table of possession limits.

Who can you give cannabis to?

Only another adult who is 21 or older. Under Penal Law § 222.50, a person 21 or older who knowingly sells or gives cannabis to someone under 21 commits criminal sale of cannabis in the third degree, a class A misdemeanor, regardless of the amount. “It was a gift” is not a defense when the recipient is underage.

That means checking, not assuming: a college student home for the holidays may be 19. If you would not hand them a drink at a bar without seeing ID, do not hand them cannabis, and keep gifts sealed and out of reach of anyone under 21 until they are in the recipient’s hands.

Why “gifting” shops and sticker deals are illegal

Because New York defines “sell” broadly. Penal Law § 222.00 says to sell means “to sell, exchange, or dispose of for compensation.” A shop that charges for a sticker or a T-shirt and hands over an eighth as a “gift” has disposed of cannabis for compensation. The sticker is the price tag, and the Office of Cannabis Management treats it that way.

OCM has said so repeatedly. In October 2021 Cannabis Control Board chair Tremaine Wright told gifting operators the conduct “is not legal and must stop.” In February 2022 the agency sent cease-and-desist letters to more than two dozen businesses pairing cannabis “gifts” with memberships or merchandise, warning of fines, possible criminal penalties, and the loss of any chance at a license. Today the OCM enforcement page states it plainly: it is illegal “to trade, barter, or ‘gift’ cannabis to someone in exchange for something else,” and OCM can issue notices of violation, cease orders, and orders to seal a storefront.

The same logic applies between individuals. “Venmo me for gas,” a cover charge at a gifting party, or swapping an eighth for a bottle of bourbon are all exchanges for compensation: an unlawful sale under § 222.45 (a violation, fine up to $250), and a class A misdemeanor under § 222.50 above 3 ounces or 24 grams.

Scenario Legal in NY? Why
Hand a sealed eighth to a friend who is 21+, no money involved Yes Transfer without compensation under § 222.05(1)(b), within 3 oz / 24 g
Buy a “sticker” and receive cannabis as a bonus No Disposing of cannabis for compensation is a sale, and the seller is unlicensed
Friend pays you back for an ounce you picked up No Reimbursement is compensation; also over the 3 oz transfer limit
Give cannabis to a 20-year-old relative No Criminal sale in the third degree, a class A misdemeanor, regardless of amount
Mail a gummy tin to a cousin in Buffalo No Federal law prohibits mailing cannabis, even within New York
Order delivery to a friend’s home; friend is 21+ and shows ID Yes Allowed under 9 NYCRR § 123.10(d)(4) when you name them at checkout
“Free” has to mean free. Any value flowing back to the giver makes it a sale.

How New York draws the line' listing legal gifts (sealed product to an adult 21 or older with nothing in return, within 3 ounces of flower or 24 grams of concentrate, delivery to a named 21-plus recipient) against illegal transfers (sticker or T-shirt bundles, reimbursement or barter, anyone under 21, mailing or crossing state lines)
Nothing of value can flow back to the giver.

Can you have cannabis delivered to someone else as a gift?

Yes, within New York, and only if you set it up at checkout. OCM’s dispensary rules (9 NYCRR § 123.10(d)(4)) say that when the person placing a delivery order will not be the person accepting it, the orderer must attest that the recipient is 21 or older, and the recipient must “provide verification of identity and age at the time of accepting the delivery.” The driver records both identities in the point-of-sale system.

So you can order a gift to a friend’s apartment in White Plains or a sibling’s house in New City, as long as the address is inside a Cannabis Realm of NY delivery zone, you enter the recipient’s exact legal name at checkout, and they are home with valid government-issued ID when the driver arrives. The order is prepaid, so they owe nothing at the door. A driver cannot leave a package on a porch, hand it to an unnamed roommate, or accept a recipient without ID, so the recipient has to know a delivery is coming; a true surprise is difficult.

Can you mail or ship a cannabis gift?

No. Cannabis remains a controlled substance under federal law, and the Postal Service and the private carriers prohibit shipping it, even between two addresses inside New York. Carrying it across a state line is also a federal matter, so a gift bought in Rockland cannot ride along to New Jersey or Connecticut, and nothing bought there can legally come back. If the person you are shopping for lives out of state, buy the gift when they visit New York.

How to gift cannabis legally at the holidays

The law does not change for the holidays. These steps keep a gift on the right side of every rule above.

  1. Buy it from a licensed New York dispensary. Legal shops display the NYS Dispensary Verification Tool in the storefront; scan the QR code and confirm the store is on OCM’s list. Product from a licensed dispensary is lab-tested, labeled, and dated.
  2. Keep it sealed, with the label. The New York retail label carries the lot number, the certificate-of-analysis QR code, serving information, and the expiration date, so the recipient can read the label themselves. Wrap the box, not the product.
  3. Confirm the recipient is 21 or older. If there is any doubt, it is not a gift you can give.
  4. Hand it over in person, inside New York. No mailing, no shipping, no crossing state lines.
  5. Accept nothing in return. A gift exchange where both people bought gifts is fine; splitting the bill is not.
  6. Stay under 3 ounces and 24 grams. Count everything you are carrying, gifts included.
  7. Store it locked until then, in the original child-resistant packaging, where no one under 21 can reach it.

One principle behind every rule: a gift is free, in person, and between adults.

What makes a good cannabis gift for someone new to it?

Start low. Low-dose edibles (2.5 mg to 5 mg per piece) and beverages are the usual pick for someone new to dispensaries, because the serving is printed on the package. Pair the gift with the basics: edibles can take 30 minutes to two hours to take effect, as our guide to how long edibles take to kick in explains. For product ideas by category, see our cannabis lover’s Christmas guide and holiday edibles guide, or ask a budtender to help you choose for someone else.

Can you gift homegrown cannabis?

The transfer rule in § 222.05(1)(b) is written in terms of cannabis, not where it came from, so the same 3-ounce, 21-plus, no-compensation conditions apply to flower grown under New York’s home-cultivation rules. Homegrown product carries no lab results or state label, though, so tested and labeled dispensary product is the safer gift.

Penalties if a “gift” crosses the line

This table reflects the text of Penal Law Article 222 as published by the New York courts; outcomes depend on the facts, and businesses face separate civil action from OCM.

Possessing more than 16 oz flower or 5 oz concentrate § 222.30 Class A misdemeanor

Frequently asked questions

Is it legal to gift weed in New York?

Yes. Penal Law § 222.05(1)(b) allows a person 21 or older to transfer up to 3 ounces of cannabis or 24 grams of concentrate, without compensation, to another person 21 or older. Both ages and the no-payment condition must all be met.

How much cannabis can I give as a gift in New York?

Up to 3 ounces of flower or 24 grams of concentrate per transfer, the same as the public possession limit. There is no extra gift allowance; everything you carry, gifts included, must stay under that cap outside your home.

Can I gift cannabis to someone under 21 in New York?

No. Under Penal Law § 222.50, an adult who knowingly sells or gives cannabis to a person under 21 commits criminal sale of cannabis in the third degree, a class A misdemeanor, regardless of the amount.

Are sticker shops and 'free gift with purchase' cannabis deals legal in New York?

No. New York defines selling as disposing of cannabis for compensation, so bundling cannabis with a sticker, T-shirt, or membership is an unlicensed sale. The Office of Cannabis Management has issued cease-and-desist letters, notices of violation, and sealing orders against gifting operations since 2022.

Can I mail cannabis to someone else in New York?

No. Cannabis is a controlled substance under federal law, and the Postal Service and private carriers prohibit shipping it, even between two New York addresses. Carrying it across a state line is also prohibited.

Can I order cannabis delivery to a friend as a gift?

Yes, inside New York. Under 9 NYCRR § 123.10(d)(4) you must attest at checkout that the recipient is 21 or older, and the recipient must show valid government-issued ID when accepting the delivery. The driver records both identities, and the order is prepaid.

Can I bring a cannabis gift from New York to New Jersey or Connecticut?

No. Transporting cannabis across state lines is prohibited under federal law regardless of either state's rules. Buy and give cannabis gifts inside New York, or let out-of-state friends shop a licensed store in their own state.

Can I gift homegrown cannabis in New York?

The transfer rule applies to cannabis generally, so homegrown flower may be given under the same conditions: both people 21 or older, within 3 ounces, and nothing in return. Homegrown product has no lab results or state label, so tested dispensary product is the safer gift.
